These Terms & Conditions (“Terms”) govern your access to and use of our website, products, and applications (collectively, the “Services”), including all applications within the Sitepulse suite (“Apps”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

By using the Services, you represent and warrant that you are at least 18 years old and have the legal authority to enter into this agreement. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Use of Services
- You agree to use the Services solely for lawful purposes.
- You will not misuse, resell, reverse-engineer, or exploit the Services.
- We reserve the right to suspend or terminate your access at any time, for any reason, without notice.
4. AI-Powered Results Disclaimer
Certain Apps and features within the Sitepulse suite are powered by Artificial Intelligence (AI). AI outputs are not guaranteed to be accurate, reliable, or error-free. By using the Services, you acknowledge and agree that:
- Results, insights, or recommendations may be incomplete, inaccurate, or misleading.
- You must exercise your own independent judgment before acting on AI outputs.
- The Services are provided on an “as-is” and “as-available” basis, with no guarantees of accuracy, completeness, or fitness for a particular purpose.
5. Limitation of Liability
To the maximum extent permitted by law:
- Sitepulse and its affiliates, officers, employees, agents, and contractors shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of data, reputational harm, performance issues, business interruption, or regulatory penalties.
- By using the Services, you assume all risks and liabilities.
- If you are dissatisfied with the Services, your sole remedy is to discontinue use.
6. Indemnification
You agree to defend, indemnify, and hold harmless Sitepulse and its affiliates from any claims, liabilities, damages, losses, or expenses (including attorney’s fees) arising from:
- Your use of the Services;
- Your violation of these Terms;
- Your violation of applicable law or third-party rights.
7. Intellectual Property
All content, software, trademarks, logos, and intellectual property associated with the Services are the property of Sitepulse or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. No ownership rights are transferred.
8. Website Terms of Use
In addition to the Apps, the Sitepulse website (the “Website”) is subject to these Terms:
- Content on the Website is for informational purposes only and may change without notice.
- We do not guarantee that the Website will be error-free, secure, or uninterrupted.
- External links may be provided for convenience; we are not responsible for the content of third-party sites.
9. App-Specific Terms
9.1 Sitepulse SEO
- Nature of Service: Provides AI-powered recommendations for search engine optimization, including but not limited to keyword research, metadata suggestions, content recommendations, and performance reporting.
- No Guarantee of Results: Search engine rankings are influenced by numerous factors outside our control, including but not limited to search engine algorithms, competitor activity, website quality, and external backlinks. We make no guarantees of ranking improvement, traffic growth, or revenue generation.
- Accuracy of Data: Data may be aggregated from third-party APIs (e.g., Google Search Console, Google Analytics, Word Tracker). We are not responsible for inaccuracies, delays, or discontinuation of third-party services.
- Compliance: SEO recommendations may not align with every search engine’s webmaster guidelines. It is your responsibility to ensure compliance with applicable search engine rules, policies, and legal obligations.
- User Responsibility: All actions taken as a result of SEO recommendations are at your own discretion and risk.
9.2 Sitepulse CRO
- Nature of Service: Provides AI-powered insights, heatmap analyses, A/B testing suggestions, and recommendations intended to improve conversion rate optimization (CRO).
- No Performance Guarantee: We do not guarantee increases in conversions, revenue, average order value, customer engagement, or any other performance metric.
- Experimental Features: CRO testing may involve design changes, layout modifications, or user experience variations that could impact site performance, sales, or brand perception. You assume all risks associated with implementing recommendations or tests.
- Third-Party Dependencies: CRO recommendations may rely on integrations with analytics, heatmap tools, or testing platforms. We are not responsible for errors, inaccuracies, or failures of those tools.
- User Responsibility: Final implementation and validation of CRO experiments remain your sole responsibility.
9.3 Sitepulse ADA
- Nature of Service: Provides accessibility scanning, analysis, and recommendations to help identify potential compliance issues with ADA, WCAG, and similar accessibility standards.
- No Compliance Guarantee: We do not warrant or guarantee that use of Sitepulse ADA will result in legal compliance with ADA, WCAG, Section 508, or any other accessibility laws, rules, or standards.
- Limitations of Scans: Accessibility issues may not be fully identified, as automated scans cannot detect all compliance failures. Manual review and legal consultation are strongly recommended.
- Legal Liability: You remain solely responsible for ensuring your website complies with all applicable accessibility laws. We are not liable for lawsuits, claims, penalties, or damages arising from accessibility issues.
- User Responsibility: By using Sitepulse ADA, you accept full responsibility for testing, remediation, and compliance.
9.4 Sitepulse Image
Provides FAQ generation and management tools. We do not guarantee accuracy, completeness, or legal sufficiency of generated content.
9.5 Sitepulse Cart
- Nature of Service: Provides tools and insights to optimize cart functionality, checkout flows, and customer purchasing experiences.
- No Guarantee of Results: We do not guarantee reduced cart abandonment, higher checkout completions, increased sales, or improved user satisfaction.
- Performance Risks: Implementation of recommendations may inadvertently introduce technical issues, reduced site speed, or negative customer experiences. You assume all risks of applying changes.
- Third-Party Dependencies: Cart analysis may require integration with payment processors, eCommerce platforms, or analytics tools. We are not responsible for errors, downtime, or policy changes by third parties.
- User Responsibility: You remain responsible for verifying all modifications and ensuring compliance with applicable eCommerce, consumer protection, and data privacy laws.
9.6 Sitepulse Compare
- Nature of Service: Provides product comparison functionality, including AI-powered or manually configured comparison tables, fields, and integrations with product catalogs.
- No Guarantee of Accuracy: Comparison results are dependent on user input, product data, and third-party integrations. We do not guarantee accuracy, completeness, or timeliness of comparison outputs.
- Performance Disclaimer: Adding comparison features may affect page load speed, design consistency, or customer experience. You assume all risks of implementation.
- Legal & Compliance: If you use comparison functionality to compare products, services, or competitors, you are solely responsible for ensuring compliance with advertising, marketing, consumer protection, and fair-competition laws.
- Third-Party Dependencies: Compare functionality may rely on platform APIs, metafields, or third-party product feeds. We are not responsible for inaccuracies, downtime, or service changes outside our control.
- User Responsibility: You are solely responsible for verifying that comparisons are accurate, lawful, and appropriate for your customers.
10. Termination
We may suspend or terminate your access to the Services at any time, without liability, for any reason including violation of these Terms.
11. Governing Law & Jurisdiction
